Sale Terms & Conditions

Terms:

• This auction will have 7% sales tax and 2.5% Buyer’s Premium capped at $750.00 added to each winning invoice.
• LOAD OUT for consigner Bobby Lee "Curly" Carr Estate: Tuesday August 25th 9AM - 4PM Location: 1483 N 600 E Lagro, IN 46941
• LOAD OUT for all other consigners: Make appointment with Seller at the contact info listed on your invoice. 
• Money Wire, Cash or Check
• Payment is due within 48 hours after the auction.
• Not responsible for accidents.
• All items are sold "AS IS', without any warranty of any kind.
• Announcements OR updates to online bidding catalog made the day of the auction take precedence over any printed material.

All items are sold AS IS, WHERE IS, with all faults, and without warranty or guarantee of any kind, express or implied. No statements made by the auctioneer, staff, seller or consignor shall be deemed a warranty. It is the responsibility of the buyer to conduct his or her own independent inspection, investigation, inquiry and due diligence concerning an item prior to bidding. Failure to inspect does not relieve the bidder of responsibility for payment or acceptance of the item. 

CORRECTIONS or CHANGES: Please check for updated information prior to the start of an auction to inspect any changes, corrections, or additions to the property information.

PARTICIPATING IN AN AUCTION: To bid online in an auction, you must register for that auction and accept its specific terms.  Successful registration for one auction does not guarantee registration for any other auction. Hiner Real Estate & Auction reserves the right to refuse to register any person for any auction. 

BIDDER VERIFICATION: Bidding rights are provisional, and if identity verification is questionable, Hiner Real Estate & Auction has the right to reject the registration, and bidding activity will be terminated at any time and without notice. The Seller and Hiner Real Estate & Auction reserve the right to preclude any person from bidding if there is any question as to the person's credentials, mental fitness, etc. Bidders agree to keep their username and password confidential as they are responsible for ALL activity involving their account. Bidder agrees their information is true, accurate and complete and Hiner Real Estate & Auction shall have the right to rely on this information. 

AUCTION PROCEDURE & SETTLEMENT: The successful bidder is responsible for making full payment within 48 hours following the close of the auction. At the conclusion of the auction, winning bidders will receive an email with an invoice attached. Payment instructions are included on the invoice. All payments must be made in US Dollars. Once payment is received, a paid invoice will be provided to the buyer. No items will be released to the buyer until payment is received in full. Payment in full includes the payment of all applicable sales tax or the submission of a sales tax exemption form. All tax documentation must match the buyer’s account details. Sales tax can only be removed from a buyer’s invoice upon receipt of a completed and validated tax exemption form. 

FAILURE TO PAY: Failure to pay in full will result in the buyer’s account being suspended from participation in all future auctions. 

BUYER RESPONSIBILITY: Buyer shall maintain insurance coverage on items purchased at auction against all perils of loss, including fire, theft, vandalism, and accident damage. The auctioneer nor seller are not responsible for loss, theft, or damage after sale.

PICKUP: Purchased items must be removed within the time announced by the auctioneer and posted in sale terms and at the buyer’s sole risk and expense. Items not removed within the stated time will be subject to storage fee of $ 25.00 per day and possible transportation fees. Items may be considered abandoned and resold without refund.

TECHNICAL ISSUES: In the event there are technical difficulties related to internet bidding, software, internet or any other online auction-related technologies, Hiner Real Estate & Auction reserves the right to extend bidding, continue the bidding, or close the bidding. Neither the company providing the software, nor Hiner Real Estate & Auction shall be held responsible for failure of bidding software, Internet connection or missed bids. 

CONDUCT OF THE AUCTION: Conduct of the auction and increments of bidding are at the direction and discretion of the Auctioneer. The Seller and Selling Agents reserve the right to preclude any person from bidding if there is any question as to the person's credentials, fitness, etc. All decisions of the Auctioneer are final.

The buyer agrees to indemnify and hold harmless Hiner Real Estate & Auction and its affiliates from and against any and all loss, liability, claim, action, cost and/or expenses (including attorney fees) resulting from, arising out of or relating to the buyer’s breach of and/or failure to comply with any term, condition, restriction, representation and/or warranty or expenses of any kind arising out of or related to the buyer’s participation in the auction, including on-site inspections.
